Procedural Posture

Stay Application / Application for Stay of Execution Pending Intended Appeal

  1. 1 Whether the applicant has demonstrated that the intended appeal is arguable.
  2. 2 Whether the intended appeal would be rendered nugatory if stay of execution is not granted.
  3. 3 Whether the respondent would be able to refund the decretal sum if the appeal succeeds.

Ratio Decidendi

The Court found that the applicant had satisfied the two guiding principles for the grant of stay under Rule 5(2)(b): the intended appeal was conceded to be arguable, and the applicant demonstrated that the respondent, given his limited income and assets, would not be able to refund the decretal sum if the appeal succeeded. Therefore, the appeal would be rendered nugatory absent a stay. The Court exercised its discretion to grant a stay of execution of the Industrial Court's award, conditional upon the applicant furnishing a bank guarantee for the decretal sum within 60 days.

Court Disposition

Application allowed; stay of execution granted pending appeal, subject to provision of bank guarantee.

Orders

  • Stay of execution of the award of the Industrial Court dated 25th September, 2014 pending hearing and determination of the intended appeal.
  • Applicant to furnish security to the respondent in the form of a bank guarantee for Kshs. 1,320,000 within 60 days.
