The Court found that while the Respondent had a valid reason for terminating the Claimant's employment due to his failure to properly notify his supervisor of his illness and absence, the Respondent failed to follow the mandatory procedural requirements set out in Section 41 of the Employment Act and its own internal disciplinary procedures. The lack of procedural fairness rendered the termination unfair. Consequently, the Claimant was not entitled to reinstatement due to his employment record, but was entitled to compensation for unfair termination, notice pay, salary for days worked, and prorata leave pay.
