The High Court determined that it lacked jurisdiction to hear and determine the appeal because the underlying dispute arose from an employment relationship and a work injury claim, which fall within the exclusive jurisdiction of the Employment and Labour Relations Court (ELRC) as established by Article 162(2) of the Constitution and Section 12 of the ELRC Act. Both parties conceded that the dispute was employment-related. The High Court's jurisdiction is expressly ousted by Article 165(5)(b) of the Constitution in respect of matters reserved for the ELRC.
