The High Court lacks jurisdiction to review or reopen decisions that have already been determined by the Court of Appeal, a superior court. The Constitution of Kenya and established case law make it clear that the High Court's supervisory jurisdiction does not extend to superior courts, including the Court of Appeal. Once the Court of Appeal has rendered a final decision on an appeal, the High Court is bound by that decision and cannot entertain applications seeking to revisit or overturn it.
