Ratio Decidendi

The court found that there was an employment relationship between the claimant and the respondent, evidenced by regular monthly salary payments. The respondent failed to provide notice of termination or prove valid reasons for dismissal as required by the Employment Act. The termination was therefore unfair. However, considering the respondent's loss of parliamentary office, the court limited compensation to six months' gross salary. The claimant was also entitled to the balance of one month's salary in lieu of notice, less amounts already paid. Judgment was entered for the claimant for Ksh.123,000 plus interest and costs, and the respondent was ordered to issue a certificate of service.
