Ratio Decidendi

The court found that the Respondent failed to provide evidence that the Claimant absconded duty, such as work attendance records, and admitted that no hearing was conducted prior to dismissal. The Respondent also failed to involve the Claimant's trade union. The court held that the dismissal was procedurally and substantively unfair under Sections 41 and 45 of the Employment Act 2007. The Claimant was not entitled to service pay due to his NSSF membership, but was entitled to one month’s salary in lieu of notice and twelve months’ compensation for unfair termination. The court ordered the Respondent to pay the awarded sums, issue a certificate of service, and bear the costs of the suit.
