Ratio Decidendi

The court found that the appellant did not appeal against conviction nor challenge the manner in which his plea of guilty was recorded. The only issue on appeal was the sentence. The appellant attempted to introduce mitigation factors on appeal that were not raised before the trial court, which the appellate court found improper. The trial magistrate could only consider mitigation presented at the time of sentencing. The fines and default sentences imposed were within the statutory limits for the offences charged and were not harsh or excessive. The appeal was therefore dismissed and the sentence of the trial court upheld.
