Ratio Decidendi

The court held that the applicants, having enjoyed occupation of the suit premises during the pendency of the injunction application as a result of interim orders, derived benefit from such occupation. The funds deposited in the joint account were a condition for their continued stay and functioned as security or compensation for use of the premises. Allowing the applicants to reclaim the funds would amount to unjust enrichment, as they would have occupied the premises for free while the respondent would have lost potential income. The respondent, as the owner, is therefore entitled to the funds, and the application for release of the money to the applicants was dismissed.
