The Court found that the applicants failed to demonstrate an arguable appeal, as the High Court's referral of the matter back to the Kadhi's court for valuation and distribution of the deceased's estate in accordance with Islamic law was not shown to be erroneous. Even if the appeal were arguable, the applicants did not satisfy the nugatory aspect, as the distribution of the estate in accordance with Islamic law would not prejudice any party in the interim. Therefore, the requirements for granting a stay of execution under Rule 5(2)(b) were not met, and the application was dismissed for lack of merit.
