Ratio Decidendi

The Supreme Court held that since the substratum of the appeal had been overtaken by events and the matter was not ripe for hearing, there was no event to which costs could follow. The respondents did not suffer any prejudice as pleadings were not served and their court attendances were limited and of the nature of mentions. The Court applied its established principles that in public interest matters withdrawn before substantive engagement, costs are not ordinarily awarded. Consequently, the application for withdrawal was allowed and each party was ordered to bear its own costs.
