Miscellaneous Criminal Application / Ruling on Sentence Review Application

  1. 1 Whether the trial court erred by failing to consider the period spent in remand custody when sentencing the applicant.
  2. 2 Whether the sentence imposed was lawful and appropriate in light of section 333(2) of the Criminal Procedure Code.

Ratio Decidendi

The court found that the trial court failed to consider the period the applicant spent in remand custody, contrary to section 333(2) of the Criminal Procedure Code and established case law. The applicant was in custody from 1 March 2021 until sentencing on 17 March 2022, amounting to one year and 16 days. The High Court, exercising its supervisory jurisdiction, held that this period must be credited against the custodial sentence. The application for review was therefore allowed, and the trial court was directed to take the remand period into account when computing the applicant's sentence.
