Ratio Decidendi

Further, the sentence of 3 years imprisonment for the offence under section 95(1) of the Penal Code was illegal as it exceeded the statutory maximum of 6 months. The appellate court therefore set aside the original sentences and substituted them with lawful sentences: 6 months imprisonment for Count 1 and 1 year imprisonment for Count 2, both to run concurrently from the date of sentencing in the subordinate court.
