The Respondent failed to provide evidence of a fair hearing or procedural fairness as required by Section 41 of the Employment Act, 2007. The Respondent also failed to prove that the Claimant was on probation or that the payslip produced was a forgery. As the custodian of employment records, the Respondent's failure to produce contrary evidence led the court to accept the Claimant's version.
