The court held that the entire petition concerns disputes relating to community land and environmental conservation, which fall squarely within the exclusive jurisdiction of the Environment and Land Court (ELC) as established by Article 162(2)(b) of the Constitution and Section 13 of the ELC Act. Article 165(5)(b) expressly ousts the High Court's jurisdiction in such matters, regardless of whether constitutional violations are alleged, as long as the substratum of the dispute is land or environment. The court found that the High Court cannot arrogate to itself jurisdiction that is constitutionally and statutorily reserved for the ELC. Consequently, the petition was declared null and void...
