Ratio Decidendi

The court found that the Claimant was unlawfully terminated because the Respondent failed to provide credible evidence that the Claimant deserted duty or received a recall letter. The suspension was indefinite, and the Claimant was not given an opportunity to be heard or informed of the charges against him, contrary to the mandatory requirements of sections 41 and 43 of the Employment Act. The Respondent's failure to follow due process and to prove a valid reason for termination rendered the dismissal unfair. The Claimant was therefore entitled to salary arrears for the period of suspension and compensation for unlawful termination, but not severance pay or unproven statutory deductions.
