The court held that the right of appeal in criminal matters is strictly statutory. Under the Constitution and the Criminal Procedure Code, only the Director of Public Prosecutions (DPP) is granted the right to appeal to the High Court from a Magistrate's Court decision, and no such right is conferred upon a private prosecutor. Section 88 of the Criminal Procedure Code, which allows for private prosecution with leave of the court, does not grant a right of appeal to the private prosecutor. In the absence of statutory authority, the private prosecutor's only recourse is to seek a remedy in a civil court.
