Procedural Posture

Employment Cause / Ruling on Application to Set Aside Closure of Proceedings

  1. 1 Whether the Respondent has shown reasonable grounds to set aside the orders closing proceedings on 3rd March 2020.
  2. 2 Whether the Respondent acted diligently and reasonably in seeking adjournment and subsequent relief.
  3. 3 Whether the Claimant is entitled to costs for the opposed application.

Ratio Decidendi

The court found that the Respondent failed to provide reasonable grounds to set aside the closure of proceedings. There was no contemporaneous communication or evidence on the hearing date that the Respondent's witness was unavoidably absent due to attending to an ailing mother. The Respondent had previously been granted an adjournment for similar reasons and had not paid the ordered costs. The court noted that the Respondent's conduct did not further the objectives of the Employment and Labour Relations Court Act, and that the Claimant's evidence remained uncontested. The Respondent's application was therefore declined, and costs awarded to the Claimant.

Court Disposition
