Procedural Posture

Civil Appeal / Ruling on Stay of Execution Pending Appeal

  1. 1 Whether the applicant is entitled to a stay of execution of the lower court's order pending appeal.
  2. 2 Whether the application was filed without unreasonable delay.
  3. 3 Whether the applicant has offered adequate security for the due performance of the decree.

Ratio Decidendi

The court found that the application for stay of execution was filed promptly, only three days after the ruling in the lower court. The applicant had already been arrested and committed to civil jail, and the court recognized that serving the sentence would cause substantial loss that could not be reversed. However, the applicant had not offered security for the entire decretal sum. To balance the interests of both parties, the court allowed the stay of execution on the condition that the applicant deposits the decretal sum in a joint interest earning account of the parties' counsels or in court within 30 days, or alternatively deposits security for Ksh.1,000,000 within the same period....

Court Disposition

Application for stay of execution allowed on condition of security.
