While the Plaintiff's claim of 1,601 trees was not fully substantiated, the court accepted a reasonable estimate of 1,601 trees at a value of Kshs 3,000 per tree, based on the evidence of the agricultural officer and the Defendant's own admissions. The court also awarded compensation for the portion of land acquired for the road, using a price index of Kshs 400,000 per acre and awarding Kshs 750,000 for 0.36 acres.
