Ratio Decidendi

The High Court found that it had already determined the applicant's appeal against conviction and sentence in Siaya HCCRA 37/2019, and had also previously dismissed a similar application for sentence revision. Applying the doctrine of functus officio, the court held that it lacked jurisdiction to entertain the present application for revision of sentence, as its authority over the matter was exhausted upon delivery of its earlier judgment. The applicant's attempt to seek further relief from the same court was improper, and the appropriate avenue for any further challenge would have been an appeal to the Court of Appeal. The application was therefore dismissed for lack of merit.
