Ratio Decidendi

The court held that the plaintiffs failed to comply with the mandatory requirement to annex certified extracts of title for all parcels of land claimed except for MN/III/2391. Consequently, the claims over all other parcels and against all other respondents were struck out. Further, since the 1st respondent (the only remaining defendant) had died and no substitution was made within the statutory period, the suit against him abated by operation of law. As a result, there was no surviving claim or defendant, and the entire suit was effectively concluded. The court granted liberty to apply for costs of the abated suit against the 1st respondent.
