The court found that the plaintiff acquired a valid title to the suit land from Wabululu Mulongo, who had lawfully purchased and been allocated the land by the family of Zakaria Makaela. The 1st defendant’s claim that only 2 acres were sold was contradicted by documentary and oral evidence, including admissions in tribunal proceedings. The Gazette Notice No 6454 of 1999, which purported to cancel the plaintiff’s title, was based on a non-existent court order and was therefore illegal and void. The Land Registrar had no power to cancel titles except by court order. The subsequent opening of a second green card, subdivision, and transfer of the land to the defendants were fraudulent acts...
