Ratio Decidendi

The court found that the judgment in question was delivered in the absence of the parties and it was unclear whether the parties were notified of the delivery date. The applicant became aware of the judgment after the statutory period for appeal had expired. In these circumstances, the court held that the applicant had provided sufficient cause for the delay and exercised its discretion to grant leave to appeal out of time. The court further directed that the memorandum and record of appeal be filed within thirty days, failing which the leave would lapse automatically.
