The Tribunal found that the applicant failed to prove she was a tenant of the respondent. The only evidence of payment was a single Mpesa transaction, which was refunded, and the business permit did not establish a tenancy relationship. The respondent's evidence, including a written agreement with the applicant's husband to vacate the premises, was uncontroverted. In the absence of a landlord-tenant relationship, the applicant was not entitled to the reliefs sought. The Tribunal dismissed the application and reference, ordered immediate delivery of vacant possession, and awarded costs to the respondent.
