Ratio Decidendi

The court found that directions on the appeal were given on 15th January 2024, while the application for dismissal was filed on 12th September 2023. According to Order 42 Rule 35(1) of the Civil Procedure Rules, an appeal is only ripe for dismissal for want of prosecution if, three months after directions have been given, the appellant has not set down the appeal for hearing. Since the application was filed before directions were given and before the statutory period had lapsed, the application was premature. The applicant failed to ascertain whether directions had been taken before filing the application. Consequently, the application was dismissed with costs to the respondent.
