The court held that, in the absence of aggravating factors expressly stated by the trial court, the sentence was excessive. The sentence for assault was found to be lawful and lenient. Given that both offences arose from the same transaction, the court ordered that the sentences run concurrently from the date of arrest. The sentence for rape was reduced to ten years' imprisonment, and the sentence for assault remained at three years, both to run concurrently.
