Procedural Posture

Civil Suit / Ruling on Application to Strike Out Defence and Enter Judgment

  1. 1 Whether the defence filed by the Defendant discloses any triable issues.
  2. 2 Whether the Plaintiff is entitled to have the defence struck out and judgment entered in its favour.
  3. 3 Whether the Defendant is truly and justly indebted to the Plaintiff for the claimed sum.

Ratio Decidendi

The court found that the Defendant's statement of defence consisted of mere denials without substance and failed to raise any triable issues. The Defendant had, in fact, admitted its indebtedness to the Plaintiff. The court was satisfied that the defence was filed solely to delay the proceedings and constituted an abuse of the court process. In such circumstances, the court was justified in striking out the defence and entering judgment for the Plaintiff, as allowing the defence to stand would prejudice and delay the fair conclusion of the action.

Court Disposition

Plaintiff's application allowed; defence struck out; judgment entered for Plaintiff.

Orders

  • The defence dated 20th February, 2012 is struck out.
  • Judgment is entered for the Plaintiff for the sum of KShs. 3,253,800.00 with costs and interest at court rates.
