The High Court found that the trial magistrate erred by relying on an authority involving more severe injuries than those suffered by the respondent, resulting in an inordinately high award of general damages. The court held that the authorities cited by the appellant, though older, were more relevant to the respondent's soft tissue injuries. Taking into account inflationary trends, the court determined that Kshs 180,000 was sufficient compensation for the respondent's pain and suffering. The special damages award was not challenged and remained undisturbed. The appeal was allowed to the extent of reducing the general damages, with the appellant awarded half the costs of the appeal.
