Procedural Posture

Environment and Land Case / Ruling on Post Judgment Application

  1. 1 Whether the court can order the Deputy Registrar to sign transfer instruments post-judgment when such relief was not sought in the pleadings.
  2. 2 Whether the doctrine of functus officio prevents the court from granting new reliefs after judgment has been delivered.

Ratio Decidendi

The court held that it was functus officio after delivering its judgment and issuing a decree, and therefore lacked jurisdiction to grant new reliefs not sought in the original pleadings. The application to have the Deputy Registrar sign transfer instruments was a substantive request that should have been included in the counterclaim before judgment. Allowing parties to seek incremental changes to the judgment post facto would undermine the principle of finality in litigation. The defendant must enforce the decree as issued and cannot seek to alter or supplement it through subsequent applications.
