  2. 2 Whether the certificate of taxation is final and conclusive in the absence of a dispute or application to set it aside.
  3. 3 Whether the applicant is entitled to interest and costs of the application.

Ratio Decidendi

The court found that the applicant had obtained a certificate of taxation for Kshs 113,284, which had not been set aside or altered, and that the retainer was not disputed. In accordance with Section 51(2) of the Advocates Act, the certificate of taxation is final as to the amount of costs covered. Since the respondent did not contest the application or challenge the certificate, the court was satisfied that the applicant was entitled to judgment for the sum certified in the certificate of taxation, together with interest at court rates from the date of judgment until full payment. The court also awarded the costs of the application to the applicant.
