Miscellaneous Application / Ruling on Withdrawal of Application and Costs

  1. 1 Whether the application before the court is capable of being entertained after the notice of withdrawal was filed.
  2. 2 Whether the respondent is entitled to costs following the withdrawal of the application.

Ratio Decidendi

The court held that the applicant was entitled to withdraw the application as provided under Order 25 Rule 1 of the Civil Procedure Rules, since the proceedings belong to the parties and may be discontinued at any stage before hearing. However, because the respondent had already filed documents in opposition, the situation was akin to a suit having been set down for hearing, thereby invoking Order 25 Rule 3. This rule entitles the respondent to costs upon withdrawal of the application. The court therefore marked the Motion as wholly withdrawn with costs to the respondent, to be taxed if not agreed.
