Legal Issues
- 1 Whether the sentence imposed on the applicant for possession of narcotic drugs should be revised in light of the circumstances.
- 2 Whether community service is an appropriate alternative to imprisonment for the applicant.
Ratio Decidendi
The court found that, given the minor nature of the offence (possession of narcotic drugs valued at Ksh 700), the applicant's guilty plea, and the period already spent in custody, a custodial sentence was not warranted. In the interest of prison decongestion and rehabilitation, the court exercised its revisionary jurisdiction to substitute the remaining custodial sentence with a community service order at Sega Dispensary for nine months, under supervision, provided the applicant does not reoffend.
Court Disposition
Sentence revised; custodial sentence substituted with community service order.
Orders
- The applicant Collins Oduor Adalla shall be released from prison unless otherwise lawfully held.
- The applicant shall serve a community service order at Sega Dispensary for nine months.
