Ratio Decidendi

The court found that the Respondent/Applicant was not served with the hearing notice for 27th June 2019, as service was only effected on the Claimant's present and former advocates, not on the Respondent's advocates. The absence of the Respondent at the hearing was therefore not deliberate. In the interests of justice and to uphold the right to be heard, the court set aside the ex parte proceedings and orders made on 27th June 2019, reopened the case, and allowed the Respondent to present its defence and cross-examine the Claimant. No order as to costs was made, as the error in service was attributable to the court process.
