Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant was unfairly terminated or resigned from employment.
  2. 2 Whether the claimant is entitled to terminal dues including house allowance and overtime for 14 years.
  3. 3 Whether the claim is time-barred or limited by statute.

Ratio Decidendi

The court found that the claimant failed to prove he was unfairly terminated, as the evidence indicated he resigned on medical grounds and was paid terminal dues in the presence of union officials. The claimant did not provide sufficient evidence of unpaid house allowance or overtime, nor did he specify his monthly salary to enable computation of further dues. The statutory limitation under Section 90 of the Employment Act restricted claims for house allowance and overtime to one year, not the 14 years claimed. The claimant signed a discharge voucher acknowledging receipt of payment, and there was no evidence of duress or non-payment. Consequently, the claim was unmerited and was dismissed.
