The trial court imposed a sentence of 4 ½ years for the offence of stealing, which under Section 275 of the Penal Code attracts a maximum penalty of 3 years. The High Court found that the sentence was illegal as it exceeded the statutory maximum. Exercising its revisionary jurisdiction under Article 165 of the Constitution and Sections 362 and 364 of the Criminal Procedure Code, the High Court set aside the illegal sentence. Considering the applicant's mitigation, plea of guilty, and status as a first offender, the court substituted the sentence with 18 months' imprisonment, to commence from the date of the original sentence.
