Ratio Decidendi

The court found that the consent letter dated 20th August 2003, executed by the parties and filed, constituted a binding compromise of the decree, and the subsequent payment of the agreed sum by the applicant's insurer, together with the respondent's execution of a discharge voucher, fully settled the matter. The failure by the Deputy Registrar to extract a formal consent order did not nullify the compromise or the parties' intention. The subsequent attachment and sale of the applicant's motor vehicle was therefore erroneous and unlawful, as the respondent was estopped from denying the settlement.
