The court found that the application for discovery and production of certified records and Deed Plans was merited, as such documents are relevant to the fair disposal of the suit and their production would not prejudice the parties. However, the court declined to expunge the letter dated 8th April, 2014 from the plaintiffs' record at this interlocutory stage, holding that its admissibility and authenticity should be determined at trial after parties have had the opportunity to testify and cross-examine.   • The applicant shall serve the details of the suit land and the plaintiffs’ titles/lease/grant in respect of which the certified record and Deed plan is being sought upon the Director of Survey together with this order.
