Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the Claimant was unlawfully terminated from employment.
  2. 2 Whether the Respondent breached the Claimant's right to privacy and defamed him through a newspaper publication.
  3. 3 Whether the Claimant is entitled to the remedies sought, including damages and certificate of service.

Ratio Decidendi

The court found that the Claimant was employed on a fixed-term contract which expired by effluxion of time, and there was no obligation on the Respondent to renew the contract or provide reasons for non-renewal. Court Disposition

Claim largely dismissed with partial success for admitted leave pay and certificate of service.

Orders

  • The Respondent shall pay the Claimant for 36.25 days of accrued leave.
