The Court of Appeal held that the Law of Succession Act governs the administration of all property of a deceased person, including trust property such as client accounts held by an advocate. The definition of 'free property' under the Act extends to property held in trust, and the Act does not exclude law firms or client accounts from its ambit. Legal Notice No. 279 of 1995, promulgated by the Law Society of Kenya, cannot override or create a parallel regime to the Law of Succession Act for the management of a deceased advocate's law firm or accounts.
