The court found that although the plaintiffs and their family had occupied a portion of land parcel Transmara/Olontare/140 for many years, their occupation was not adverse within the meaning of the law because the land was subject to adjudication proceedings under the Land Adjudication Act. The period for adverse possession could only begin to run once the adjudication process was finalized, which occurred on 15th September 2015. As such, the plaintiffs had not occupied the land adversely for the requisite statutory period of 12 years after the finalization of adjudication.
