The court held that, although the ELRC (Procedure) Rules, 2016 did not expressly provide for service on a respondent domiciled outside Kenya, the new ELRC (Procedure) Rules, 2024 now address this issue. Where there is a lacuna in the ELRC Rules, the court may borrow from the Civil Procedure Rules. Since the Respondent is a foreign entity incorporated in South Africa, service of summons could only be effected with leave of the court under Order 5 Rule 21 of the Civil Procedure Rules, 2010. The Claimant’s employment contract was made in Kenya, bringing the matter within the ambit of Order 5 Rule 21(e).
