The court found that although the applicant's delay of four months in bringing the motion was not inordinate and the explanation for the delay was satisfactory, the existence of an unchallenged interlocutory judgment rendered the application for leave to appeal out of time against the earlier ruling untenable. The court held that the subsequent judgment had surpassed the effect of the interlocutory rulings, and since the judgment had not been appealed or set aside, it was not possible to grant the orders sought.
