The Court of Appeal held that, following the Supreme Court's decisions in Nyutu Agrovet Limited v Airtel Networks Kenya Limited and Synergy Industrial Credit Limited v Cape Holding Limited, an appeal from a High Court decision made under section 35 of the Arbitration Act does not lie as of right. Such an appeal is only permissible in exceptional circumstances, and typically only with leave of the court. In this case, the appellant did not seek or obtain leave to appeal the High Court's decision setting aside the arbitral award.
