Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the application for stay of execution is competent in the absence of a filed appeal against the impugned ruling.
  2. 2 Whether the Applicant is entitled to orders setting aside the warrants of attachment and the default judgment pending appeal.

Ratio Decidendi

The court found that the Applicant's application for stay of execution and setting aside of warrants of attachment was premised on an intended appeal against the ruling delivered on 27th August 2020. However, there was no appeal on record against this ruling, nor was there any prayer for extension of time to file such an appeal. As a result, the application was deemed incompetent, as the court cannot grant stay of execution in the absence of a valid appeal or an application for extension of time. The court therefore struck out the application with costs to the Respondent.
