Ratio Decidendi

The court found that the interim orders restraining the Respondent from auctioning the Applicant's property were not extended beyond 17th April 2023. The Applicant failed to move the court for an extension of the orders, and no directions were given to that effect. As a result, there were no valid or subsisting court orders in force at the time the Respondent instructed the auctioneers to proceed with the sale. Without operative court orders, the Respondent could not be held in contempt. The application for contempt and stay of execution therefore lacked merit and was dismissed with costs to the Respondent. The interim stay of execution orders were also discharged.
