Ratio Decidendi

The court held that there is no legal basis for a defendant to withdraw or recant a statement of defence under the Civil Procedure Rules. The proper procedure for altering a defence is by amendment under Order 8, not withdrawal or recantation. However, as to the witness statement, the court found that a party may recant their testimony, but such recantation, especially when made on oath, becomes part of the evidence and is subject to cross-examination. Therefore, the application to recant the defence was declined, but the application to recant the witness statement was allowed, with the caveat that the recantation is itself evidence and open to challenge in court.
