The Plaintiff paid the agreed consideration and took possession of the land, but the Defendant failed to provide the title deed and attempted to vary the terms of the agreement and refund the purchase price. The Defendant's actions constituted a breach of contract. The court held that a resulting trust arose in favour of the Plaintiff, as he had advanced the purchase money and was allowed possession.
