Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant's termination was unlawful or unfair under the Employment Act.
  2. 2 Whether the respondent followed due process in suspending and/or terminating the claimant.
  3. 3 Whether the claimant is entitled to terminal dues, including notice pay and salary during suspension.

Ratio Decidendi

The court found that the respondent, after police investigations exonerated the claimant from theft allegations, called the claimant back to work, which was an admission that there was no valid reason for termination. However, the claimant's refusal to resume duties, despite being invited, mitigated the respondent's liability. The court declined to find unfair termination but ordered payment of one month's salary in lieu of notice and salary for the suspension period, as the claimant was not paid during that time. The claim for overtime and service pay was dismissed due to lack of evidence and NSSF registration, respectively.

Court Disposition

Partial award for claimant; no finding of unfair termination.
