Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution and Notice of Change of Advocates

  1. 1 Whether a notice of change of advocate filed after judgment requires leave of the court under Order III Rule 9A of the Civil Procedure Rules.
  2. 2 Whether Ombachi Moriasi & Company Advocates were properly on record for the appellants without obtaining leave of court.

Ratio Decidendi

The court held that the appeal is a continuation of the proceedings in the lower court, and therefore, the advocate on record in the lower court remains the advocate for the parties until the conclusion of the appeal unless a notice of change of advocate is filed with leave of the court as required by Order III Rule 9A of the Civil Procedure Rules. Since Ombachi Moriasi & Company Advocates filed a notice of change of advocate without obtaining the necessary leave, they were improperly on record. The court struck out the notice of change of advocates for non-compliance with the mandatory procedural requirements.

Court Disposition

Notice of change of advocates struck out for want of leave; Ombachi Moriasi & Company Advocates improperly on record.

Orders

  • The notice of change of advocates filed by Ombachi Moriasi & Company Advocates is struck out.
