Procedural Posture

Criminal Appeal / Application for Bail Pending Appeal

  1. 1 Whether the appellant has demonstrated exceptional circumstances to warrant grant of bail pending appeal.
  2. 2 Whether the appeal has overwhelming chances of success to justify bail.
  3. 3 Whether the sentence imposed is likely to be served before the appeal is heard.

Ratio Decidendi

The court found that while the grounds of appeal were arguable, the appellant failed to demonstrate exceptional circumstances or substantial points of law or evidence to justify the grant of bail pending appeal. The court noted that the sentence imposed was not illegal and that, although a substantial part of the sentence might be served before the appeal is heard, this alone was insufficient to warrant bail. The court emphasized that the presumption of innocence no longer applied post-conviction and that the criteria for bail pending appeal are more stringent. Consequently, the application for bail pending appeal was dismissed for lack of merit.
